“A Technicality Called Democracy”

New Jersey’s “TRU-ID program” website is officially offline, Save Jerseyans.

Earlier today, the American Civil Liberties Union (ALCU) won a court fight to prevent our state from implementing new, stricter driver’s license requirements.

Specifically, under the “TRU-ID program,” New Jersey would’ve joined eight other U.S. states in issuing motor vehicle licenses with distinct gold stars posted in the upper right corner.

This relatively small change would’ve rendered state-issued driver’s licenses de facto federally approved documents. Beginning in Dec. 1, 2017, Garden State residents couldn’t use their driver’s licenses to visit certain federal government complexes or gain entry to domestic flights without this updated ID…

We know how the ACLU is ever-concerned about obstacles capable of making it harder for anyone to obtain anything under all circumstances. Period.

This time, its lawyers complained about the TRU-ID program’s onerous requirements and potential cost – both things our liberal friends usually don’t care about!

Some TRU-ID changes, however, made a good deal of sense from a security perspective. For example: “If an applicant’s name is different from the name on his or her civil birth certificate (i.e. maiden name), then the applicant must show legal proof of the name change. The proof must link the present name to the previous name.”  I pulled that from a public cached version of the MVC’s now-defunct site (click here to view). Large-scale terrorist event like 9/11 are obviously easier to engineer/replicate when obtaining phony driver licenses is a walk in the park.

But since when do some of these libs care about security? At today’s Newark press conference, ACLU-NJ executive director Deborah Jacobs crowed how “The ACLU was able to get the TRU-ID program stopped on a technicality… It’s a technicality called democracy.”

True… to an extent. Thank God we’re a nation of laws where, for the most part, our government is still constrained from interfering in all areas of our lives without at least respecting basic principles of due process.

That being said, “limited government” is not the same thing as anarchy! Whether we’re discussing a privilege (like motor vehicle operation) or a right (like voting in public elections), the ability of other franchisees to meaningfully exercise said institution is contingent upon the prevention of widespread fraud and abuse. Reasonable requirements for access shouldn’t alarm anyone, libertarians and statists alike, provided the requirements don’t discriminate on the basis of gender, ethnicity, and other immutable or equally inappropriate characteristics.

Like requiring a valid photo ID card to vote so its holder cannot vote as someone else. Or mandating that a gym membership card isn’t sufficient to gain a driver’s license which, in turn, can be used to board a plane!

Such common sense measures protect our democracy and enable lawyers (like yours truly) to continue playing with technicalities in peace and security.

  1. NJ already has a point system for acquiring a drivers license, and if one is using a married name, one of the required documents is a copy of the marriage license. This has been in place since at least 2003 … so what's the fuss about? I do think we should add a designation for those who get drivers licenses while here on a temporary visa. That should be noted on the license along with the an expiration date that matches the expiration date of the visa. Several of the 9/11 terrorists were here on visa's, some of which had expired, if I remember correctly, at least one of those had been stopped for a traffic violation. If the license became invalid on the date his visa had expired, history might have played out differently.
