Lesniak Won’t Quit! Big Gov’t Foreclosure Bill Back for Round 2

Senator Ray Lesniak is a resilient political creature, Save Jerseyans.

After his awful piece of legislation passed along party lines and then was vetoed by Governor Christie for being, well, an awful piece of legislation, Ray is at it again. In an attempt to slap lipstick on this pig, some minor changes have been made to the bill while leaving its substantive effects on New Jersey homes, communities, and families completely in tact.

For those of you who may not have been paying attention back in April when this garbage first came out, here is what you missed…

This bill allows the state to swoop into your town and pick off foreclosed properties and turn them into low income housing units for “individuals with special needs.” While the quoted phrase seems innocuous, it is actually quite over broad. That term could refer to numerous categories of people ranging from those who are merely disabled down to pedophiles, criminals, sex offenders, and drug addicts.

What’s worse is that the seized homes would be held under government control for 30 years before being released back onto the open housing market.

To administer the program, a new state agency was to be created, because we know the Democrats cannot pass a bill without literally growing government. According to the New Jersey Herald, that part of the bill has been stripped from the new version. However, they are reporting that some other glaring issues seem to remain:

…unanswered is whether homes turned into special-needs housing would become tax-exempt and, if so, whether municipalities would be compensated for the loss of those tax ratables.

A very practical problem that should have a lot of municipalities worried.

The bottom line is that this bill was bad in April, and its still bad today. As version 2.0 makes its way through the committee and amendment process once again, I do not believe that any amount of editing will make this bill palatable while maintaining the character of what the left is trying to do. There is simply no positive way to spin a bill that takes home from families who are struggling to keep them, and potentially turns them over to some of the worst society has to offer at the government’s whim.

Hopefully the GOP caucuses and Governor Christie ensure that Round 2 for the New Jersey Foreclosure Transformation Act goes exactly the way Round 1 did.
