Rep. Nancy Mace, a Republican from South Carolina, wants to expel LaMonica McIver (D, NJ-10) from the U.S. House of Representatives following Alina Habba’s decision to charge her for an alleged assault at a Newark ICE detention facility.
“On May 9th, McIver didn’t just break the law, she attacked the very people who defend it,” Mace explained in her accompanying statement. “Attacking Homeland Security and ICE agents isn’t just disgraceful, it’s assault.”

Acting New Jersey US Attorney Alina Habba for New Jersey charged McIver with two individual felony counts this week following a small-scale riot at Delaney Hall.
If the process initiated by Mace ever makes it to the House floor? It’s unlikely to pass in the tightly divided chamber since a two-thirds supermajority is required. Only six members have been expelled in the entire history of the House and only three in the post-Civil War era; the most recent member to earn this dubious distinction was George Santos in 2023.
