Federal appeals court says Murphy can’t ban private ICE detention centers

On Tuesday, U.S. appeals court ruled in a 2-to-decision that New Jersey cannot enforce a law estopping the federal government from using third party private firms in the operation of immigration detention centers.

The federal court’s ruling is a major victory for the Trump Administration’s national crackdown on illegal aliens.

U.S. Circuit Judge Stephanos Bibas explained that “[j]ust as states cannot regulate the federal government itself, they cannot regulate private parties in a way that severely undercuts a federal function.”

Governor Murphy signed a law back in 2021 which prevented the renewal of CoreCivic’s Elizabeth Detention Center operating agreement with U.S. Immigration and Customs Enforcement (ICE).

Bibas no “interferes with the federal government’s core power to enforce immigration laws.”
