3rd Circuit panel sides against Habba in U.S. Attorney appointment flap

Alina Habba’s fate as U.S. Attorney for the District of New Jersey continues to hang in the balance.

On Monday, a Third Circuit Court of Appeals panel ruled 3-0 that Alina Habba cannot serve as U.S. Attorney or acting U.S. Attorney, affirming U.S. District Judge Matthew Brann’s August opinion that Alina Habba, the President’s former White House counsel, had no standing to serve as Acting U.S. Attorney since July 1, 2025.

The three-judge panel alleged that the Trump Administration’s position would, if allowed to stand, “effectively [permit] anyone to fill the U.S. Attorney role indefinitely” which in their collective mind “should raise a red flag.” 

The Administration can now look ahead to a showdown at the U.S. Supreme Court or try its luck with the full U.S. Circuit Court of Appeals…
