Stun Guns Are Now (Almost) Legal in New Jersey

You’ll soon be in luck.

On Thursday, a federal judge of the United States District Court for the District of New Jersey signed a consent order pursuant to which the state must come up with new regulations “consistent with public safety and the Second Amendment” within the next 180 days.

The order results from a challenge brought against New Jersey’s existing ban contained in N.J.S.2C:39-3(h) which provided that “any person who knowingly has in his possession any stungun is guilty of a crime of the fourth degree.”

“This is a victory for the law-abiding people of New Jersey who want the non-lethal capability to protect themselves with a stungun,” said Senator Tony Bucco (R-Morris). “This federal court order sends the message that the State of New Jersey has gone too far in interfering with the Second Amendment rights of New Jerseyans to protect themselves and their families.”

Bucco sponsored S-1106 which was written to repeal the ban prior to today’s outcome in federal court.
