Employee, fired for criticizing BLM on Facebook, loses N.J. appeal

The latest: a New Jersey health care company reportedly fired an employee for criticizing Black Lives Matter on Facebook, and a New Jersey appellate court has dismissed the employee’s appeal in a published decision.

According to the New Jersey Law Journal

During protests over the murder of George Floyd by police, another Facebook member posted the question, “Do you believe the phrase Black Lives Matter is racist?” McVey replied, “Yes, I find it racist. Yes[,] it bothers me. ‘Black lives’ matter causes segregation. Have you ever hear[d] of ‘white lives’ matter or ‘[J]ewish’ lives matter[?] No. Equal opportunity.”

The other member then posted that Black Lives Matter “is bringing attention to the plight of [B]lack folks in America. That they’re dying.” McVey responded by posting, “[T]hey are not dying … they are killing themselves.” McVey later added that she “support[ed] all lives … as a nurse they all matter[,] and [she] d[id] not discriminate.” McVey also wrote that she did “not condone the rioting that ha[d] occurred in response to ‘this specific [B]lack man[‘]s death.’”

Since the fired employee worked at-will for a private company (AtlantiCare), the appeals court ruled that the First Amendment simply didn’t provide any protections from termination in this context.
