Bridgegate Court rejects dismissal motion

U.S. District Court Judge Susan Wigenton was unmoved by the attempts of Bridget Anne Kelly and Bill Baroni to dismiss the cases against them on the grounds of alleged due process violations and an insufficient factual basis, Save Jerseyans.

The Bridgegate defendants learned this fate in a Tuesday ruling. The pair have consistently complained about problems with the state’s body of evidence owing to the Christie Administration’s alleged destruction of texts and records.

“This Court finds nothing unfair in the Government’s dealings with Defendants as to document discovery or any other facet of this matter,” Judge Wigenton wrote. “Defendants make much of the fact that they are private individuals involved in a case against the United States Government and adverse non-parties with significant resources, … but this is not an uncommon state of affairs. While rhetorically satisfying, labeling oneself a ‘David’ to the Government’s ‘Goliath’ is insufficient to create a violation of Due Process.”

Today’s proceedings are distinct from the active appellate matter, currently before the Third Circuit, over whether media organizations will can access to a list of alleged co-conspirators.

The criminal trial is scheduled to begin on September 12th.
