A federal judge has denied Congresswoman LaMonica McIver’s motion to dismiss her federal criminal charges, Save Jerseyans.
McIver, a North Jersey Democrat, is accused of assaulting a federal officer at Newark’s Delaney Hall immigration facility back in May 2025 contemporaneous with the arrest of Newark Mayor Ras Baraka (whose charges were later dropped). You can click here to read the indictment.
The Congresswoman had argued that, as a member of the U.S. Congress, she couldn’t be prosecuted since she was allegedly conducting oversight of a federal immigration facility and, in so doing, exercising official official duties. McIver’s attorneys also alleged “vindictive prosecution.”
