Carl Lewis has been told yet again that he cannot run for Senate in the 8th Legislative District. However, no matter how many times he seems to be told he keeps trying. Must be that never say die olympian spirit. Expect an appeal to Federal District Judge Hillman’s decision in the coming weeks, but really it should be too late. Ballots are set to be printed soon, and no legal theory would support placing his name on it.
For those of you who have not been following this since April, Lewis does not live in New Jersey, he lived in California until very recently. The New Jersey State Constitution requires that candidates for the Senate to live in their district for four years prior to assuming the nomination. People who challenge this requirement often do so on discrimination grounds, but Judge Hillman threw that argument right where it belongs…
The durational residency requirement applies to all, regardless of economic status, race, creed, color, age, gender, and political affiliation . . . And it applies, has been applied, and ought to be applied, equally to the famous and the obscure, to the overachiever and the pedestrian, to the athletically gifted and the passive observer.
Lewis has not been certified as the general election candidate by Lt. Governor Kim Guadagno. Due to the fact that the election is two months away, this will have to be settled very very soon.
