BRUEN FALLOUT: Challenge to N.J. magazine ban remanded by SCOTUS

New Jersey’s anti-Second Amendment “justifiable need” standard went out the window last week following Justice Thomas’s opinion in New York State Rifle & Pistol Assn.,
Inc. v. Bruen, but that may’ve just been the beginning of the fallout.

On Friday, the U.S. Supreme Court granted certiorari in Association of New Jersey Rifle & Pistol Clubs, Inc. v. Attorney General New Jersey, an ongoing challenge to New Jersey’s ban on ammunition magazines exceeding ten rounds.

SCOTUS promptly remanded the case to the United States Court of Appeals for the Third Circuit “for further consideration” in light of the Bruen decision.

There’s also a pending challenge to a Maryland assault weapon law that was remanded, too.

“The High Court had been holding the mag ban case awaiting its decision in Bruen. These developments strongly imply that the outcome of the mag ban case might be different under the new Bruen rules,” ANJRPC explained in a statement. “The Supreme Court also took a similar action in a challenge to an assault firearms ban in Maryland. This also implies that assault firearms bans may not survive scrutiny under Bruen, and the potential implications for New Jersey are significant.”
